Terms & Conditions - Yoga for Fertility.

This agreement is entered into between Johanna Olivas, Luna Serenity, operating at various locations in United States and worldwide, and yourself ("I") for this and future visits.

DISCLOSURES ABOUT YOGA FOR FERTILITY: Johanna Olivas, is not a licensed medical care provider and is not rendering personal medical advice or treatment, and has no expertise in advising on, diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of yoga, sound therapy on any medical condition. You acknowledge and agree that when participating in any class or workshop, and/or when using any products or services, there may be the possibility of detoxification symptoms or physical injury, and you assume the risk and responsibility for any such results.

 

ASSUMPTION OF RISK: I agree that I am voluntarily participating in yoga at my own risk and assume all risk of injury, illness, damage, or loss to me or my property that might result, including, without limitation, any loss or theft of any personal property, whether arising out of the negligence of Johanna Olivas or otherwise.

 

I understand that yoga includes physical movements as well as an opportunity for relaxation, stress re-education and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will listen to my body, adjust the posture and ask for support from the teacher. I will continue to breathe smoothly.

Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. I affirm that I alone am responsible to decide whether to practice yoga, sound healing, or any other energy therapeutics offered. I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against Johanna Olivas.

RELEASE: I agree that on behalf of myself (and all my personal representatives, heirs, executors, administrators, agents, and assigns) to release and discharge Johanna Olivas, Luna Serenity (and its affiliates, related entities, employees, agents, representatives, successors, and assigns) from any and all claims or causes of action (know or unknown) arising out of negligence from any of its staff, whether active or passive. 

 

This waiver and release of liability includes, without limitation, injuries which may occur as a result of a) any equipment or facilities which may malfunction or break, b) improper maintenance of any equipment, premises or facilities, c) negligent instruction or supervision, d) slipping or tripping and falling while on any portion of a premises or while traveling to or from any of the activities, including injuries resulting from staff or anyone else's negligent inspection or maintenance of the facility or premises.

 

ACKNOWLEDGEMENTS: This release is not intended as an attempted release of claims of gross negligence or intentional acts. I acknowledge that I have carefully read this waiver and release and fully understand that it is a release of liability, express assumption of risk and indemnity agreement. I am aware and agree that by executing this waiver and release, I am giving up my right to bring a legal action or assert a claim against Johanna Olivas’ negligence. I have read and voluntarily signed the waiver and release and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.
